Intellectual Property Rights

In Azerbaijan, relations concerning copyright and related rights are regulated by the Law of the Republic of Azerbaijan No. 115-IQ dated June 5, 1996, “On Copyright and Related Rights.” This law governs legal relations related to the creation and use of works of science, literature, and art within the territory of the Republic of Azerbaijan, as well as protects related rights such as performances, phonograms, and broadcasts of broadcasting and cable organizations. A number of amendments and additions were made to this law between 2001 and 2021.

Azerbaijan places special importance on international cooperation in the field of intellectual property and is a member of the World Intellectual Property Organization (WIPO). The implementation of a unified state policy in this field, as well as oversight and coordination functions, are carried out by the Intellectual Property Agency of the Republic of Azerbaijan.

Intellectual property legislation protects the rights of authors and owners of inventions, written works, musical compositions, designs, software, and other intellectual products. The main types of intellectual property in Azerbaijan include copyrights, trademarks, patents, and commercial (trade) secrets.

The key legal acts regulating this field include:

  • Law on Copyright and Related Rights

  • Law on Trademarks and Geographical Indications

  • Patent Law

  • Law on Enforcement of Intellectual Property Rights and the Fight Against Piracy

  • Law on the Legal Protection of Topographies of Integrated Circuits

  • Law on the Legal Protection of Databases

A trademark protects a name, logo, symbol, or design used to distinguish a company’s goods or services. In Azerbaijan, trademark registration is carried out by the Center for Examination of Patents and Trademarks under the Intellectual Property Agency, and the process usually takes 6–9 months.

A patent provides legal protection for new inventions and grants the owner the right to prohibit the manufacture, use, distribution, and importation of the invention. Patent rights may be sold, licensed, or otherwise transferred.

Trade secrets are confidential information that is protected without registration and provides a competitive advantage to its owner. To protect such information, the owner must take appropriate confidentiality measures.
