Workplace Attestation Service

Workplace attestation is the process of measuring, assessing, and determining compliance of workplace conditions with occupational health and safety regulations.

Its purpose is to identify hazardous and harmful factors in the working environment and to develop preventive measures that protect employees’ health.


Legal Framework in Azerbaijan

Workplace attestation in Azerbaijan is primarily regulated by:

1. Labour Code of the Republic of Azerbaijan

According to Article 64 of the Labour Code, workplace attestation is conducted to ensure safe and healthy working conditions, improve labor productivity, and introduce modern technological methods.

2. “Rules on Conducting Workplace Attestation”

(Cabinet of Ministers Resolution No. 38 dated 06.03.2000)

All workplaces in the Republic of Azerbaijan — regardless of ownership or legal form — must undergo attestation.

These Rules define the responsibilities of the employer, the commission, and the full procedure of attestation.


Objectives of Workplace Attestation

Attestation is conducted to:

🔹 Identify hazardous and harmful production factors
🔹 Assess sanitary and hygienic conditions
🔹 Improve labor productivity and efficiency
🔹 Introduce modern technologies and organizational methods
🔹 Ensure proper occupational safety measures


Frequency and Timing

According to legislation:

✔ Workplace attestation must be conducted at least once every 5 years.
✔ If working conditions change (technology updates, equipment replacement, etc.), re-attestation is mandatory.


Attestation Commission

A workplace attestation commission must be established within the company.

The commission:

  • Consists of experienced specialists capable of evaluating working conditions

  • Includes experts in occupational safety, hygiene, and related fields

  • Makes objective decisions in compliance with legislation


Main Stages of Attestation

  1. Identification of Risk Factors
    Noise, dust, lighting, microclimate, injury risks, and other environmental factors are assessed.

  2. Instrumental Measurements
    Laboratory equipment is used to measure hazardous indicators.

  3. Evaluation and Comparison
    Workplace conditions are compared against regulatory standards.

  4. Documentation of Results
    Findings are recorded and submitted to the relevant state authority.


Submission of Documentation

Under current regulations, attestation documents must be submitted to the relevant executive authority (for example, the State Labour Inspectorate Service) within 10 working days.


Risks of Non-Compliance

Failure to conduct workplace attestation properly or on time may result in:

• Administrative liability
• Financial penalties
• Regulatory intervention affecting company operations

Workplace attestation is not a formality.
It is a legal obligation and a critical risk management instrument.
